The Spanish Patent and Trademark Office (SPTO)

Infringements of industrial property rights

Offences against industrial property rights

Consequences caused by the consumption of counterfeit products

The Spanish Patent and Trademark Office (SPTO), an autonomous body attached to the Ministry of Industry, Trade and Tourism, values the importance of these data and points out that they contribute to raising public awareness of the negative consequences caused by the consumption of counterfeit products in our country.

Infringements of industrial property rights have negative consequences for the economy in general because they destroy direct jobs, reduce the sale of legal products and generate undesirable effects in areas such as social and consumer health and safety, since counterfeit products evade the existing rules in this area, as well as the controls and inspections required for their subsequent marketing in a safe manner.

Likewise, the SPTO stresses the importance of having this information to design and implement the most effective public policies for protecting industrial property rights and combating infringement, an objective to which the office is firmly committed.

In this area, 1,087 operations were carried out, resulting in the arrest or investigation of 1,037 people for offences against industrial property rights.

The data on interventions and police activity against the sale of counterfeits have been published by the Ministry of Home Affairs on the Crime Statistics Portal and include operations by the National Police, the Guardia Civil, the Navarre Police, the Mossos d’Esquadra and various local police forces.

The highest percentage of counterfeit products seized by the FCSE corresponds to the toy sector (16.6 per cent). It is followed by textiles (12.5 per cent), footwear (10.2 per cent) and leather goods and accessories (3.8 per cent).

In terms of points of seizure, the largest quantity of counterfeit goods was found in warehouses, factories and storage facilities (62.5 per cent), followed by commercial establishments (16.1 per cent) and customs premises, ports and airports (4.1 per cent).

Madrid, Andalusia, Valencia, Aragon and Catalonia are the autonomous communities where the largest number of counterfeit goods have been seized.
