Those who manipulate the human genes so as to alter the genome for purposes other than eliminating or decreasing serious flaws or diseases, shall be punished with a sentence of imprisonment from two to six years and special barring from public employment and office, profession or trade for seven to ten years.
2. Should alteration of the genome be perpetrated due to serious negligence, the punishment shall be a fine from six to fifteen months and special barring from public employment and office, profession or trade from one to three years.
1. The use of genetic engineering to produce biological weapons or those intended to exterminate human beings shall be punished with a sentence of imprisonment of three to seven years and special barring from public employment and office, profession or trade for a term of seven to ten years.
2. Those who fertilise human ovules for any purpose other than human procreation shall be punished with a sentence of imprisonment from one to five years and special barring from public employment and office, profession or trade from six to ten years.
3. The same penalty shall apply to punish creation of identical human beings by cloning or other procedures aimed at racial selection.
1. Whoever carries out assisted reproduction techniques on a woman without her consent shall be punished with a sentence of imprisonment from two to six years and special barring from public employment and office, profession or trade for a term of one to four years.
2. Prosecution of this offence shall require it to be denounced by the victim or her legal representative. Should she be a minor, incapacitated, or a handicapped person, the Public Prosecutor may also denounce the offence.
In the felonies defined in this Title, the judicial authority may impose any one or number of the consequences foreseen in Article 129 of this Code when the offender belongs to a company, organisation or assembly which engages in these activities, even though only transitionally.
